General Terms and Conditions

Terms for digital services provided to consumers under Austrian law (FAGG, KSchG, VGG), applicable regardless of your country of residence. Provider: see the imprint.

This is an English convenience translation; the German version is legally binding.

1. Scope and contracting party

Bernhard Götzendorfer, sole proprietorship (not entered in the Austrian company register), Rittingergasse 15/11, 1210 Vienna, Austria ("we", "BewerbungsGenie") operates the website bewerbungsgenie.at and the associated software-as-a-service application.

These Terms apply to all contracts for the use of BewerbungsGenie that consumers conclude with us, regardless of their country of residence. A consumer is anyone who concludes the contract for purposes that are predominantly outside their trade, business or profession (in Austria § 1 KSchG, Consumer Protection Act); outside Austria the definition of consumer under the applicable law governs.

Our offering is directed exclusively at consumers. We do not conclude contracts with businesses for commercial use of BewerbungsGenie on the basis of these Terms. Conflicting or supplementary terms of users do not become part of the contract, even if we do not separately object to them.

The language of the contract is the language in which you conclude the contract: German or English. The version of these Terms in that language is binding for your contract. Statutory rules of interpretation and mandatory consumer rights remain unaffected.

2. Services

Free, Premium (monthly) and Career Boost (one-off, 3 months) as per the pricing page. BewerbungsGenie supports you with profile building, job search, application creation, interview preparation and application management.

AI-generated or AI-suggested content (texts, assessments, matching results) are suggestions without any guarantee of success, in particular no guarantee of interview invitations, interviews or job offers. You review and are responsible for every application before you send it. The evidence check flags statements that are not substantiated in your profile; it does not replace your own review of the content.

3. Conclusion of contract, prices, payment

The contract for a paid plan is concluded once you complete the purchase at checkout (Stripe) and payment is confirmed. All displayed prices are final prices and include any value-added tax due in your country of residence. Where taxes must be stated separately by law (for example US sales tax), they are shown to you at checkout before you complete the purchase.

Payments for paid plans and photo packs are handled by Stripe as merchant of record (within the European Economic Area by Stripe Payments Europe, Ltd., outside it by the responsible Stripe entity). Stripe is therefore the seller of the payment transaction: Stripe calculates and collects any value-added and sales taxes, remits them to the competent authorities, issues your invoice or payment receipt, and handles refunds and payment disputes. Stripe's buyer and payment terms apply in addition (stripe.com/legal).

The service itself, access to BewerbungsGenie and all functions it contains, continues to be provided by us. Claims arising from performance of the service, in particular warranty and withdrawal, are therefore addressed to us (§ 4 and § 8).

You receive the invoice or payment receipt electronically by email; your purchase history is additionally available in your account.

4. Right of withdrawal (FAGG)

Consumers have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Bernhard Götzendorfer, sole proprietorship (not entered in the Austrian company register), Rittingergasse 15/11, 1210 Vienna, Austria, hallo@bewerbungsgenie.at) by an unambiguous statement (e.g. by email or using the sample withdrawal form below) of your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient for you to send the notice before the withdrawal period expires.

You can also declare your withdrawal via our withdrawal function: the "Withdraw from contract" link at the bottom of every page and in your settings under "Plan". You'll get an acknowledgement of receipt by email right away.

Sample withdrawal form (its use is voluntary; an informal withdrawal is sufficient): "I/we hereby give notice that I/we withdraw from my/our contract for the provision of the following service or digital content: BewerbungsGenie Premium / Career Boost / Photo pack (please specify). Ordered on: […]. Name of consumer(s): […]. Address of consumer(s): […]. Date: […]."

Early start for Premium and Career Boost: both are services. If you expressly request that we begin before the withdrawal period expires and you withdraw afterwards, you pay us a proportionate amount for the service provided up to the withdrawal (§ 16 FAGG, Austrian Distance and Off-Premises Contracts Act). We calculate it to the day from the price of the paid period. Your right of withdrawal only ends once the service has been fully provided (§ 18(1)(1) FAGG). We obtain your request at checkout via a separate, non-preselected checkbox and confirm it to you by email.

Photo packs: you buy a photo pack separately; it is digital content not supplied on a physical data carrier. Your right of withdrawal ends when provision begins, provided you have first expressly agreed that we begin before the withdrawal period expires and have acknowledged that you thereby lose your right of withdrawal (§ 18(1)(11) FAGG). We obtain both at checkout via two separate, non-preselected checkboxes and confirm them to you by email.

Refunds are handled via Stripe and credited to the payment method used for the purchase. We repay the amount due to you after a withdrawal without undue delay and at the latest within 14 days after receiving your withdrawal.

If you reside outside the European Union, the statutory withdrawal and return rights of your country of residence remain unaffected; we grant you the right of withdrawal described above regardless of your place of residence.

5. Term and termination

Premium can be cancelled monthly; cancellation takes effect at the end of the current billing period. There is no entitlement to a pro-rata refund for periods already paid, unless otherwise required by law.

Career Boost is a one-off purchase with a term of 3 months and ends automatically thereafter, without requiring cancellation.

6. Usage rights and obligations

You may use BewerbungsGenie exclusively for your own job search. You are responsible for the accuracy of your profile information and for the content of uploaded documents; you may not upload third-party data without their consent.

You may not automatically retrieve (scrape), mirror or pass on our job database or its underlying sources to third parties. Every displayed job posting carries a documented origin and licence basis; jobs with restricted licences are visible only to the account entitled to them.

Some of these sources are curated by us manually: we select them individually, approve them individually, document the approval and take responsibility for the technical retrieval ourselves, including where the technical instructions on the operator site (robots.txt) do not provide for automated retrieval. These are publicly accessible job postings on the employers’ own career portals. We display them to you exclusively for your own job search and remove such a source as soon as the operator objects. These postings may therefore disappear without prior notice.

We respect any reservation of rights against text and data mining without exception: if a source signals such a reservation, we do not retrieve it, regardless of whether we had approved it before. On request at hallo@bewerbungsgenie.at we will tell you which sources we curate manually.

Automated mass applications without substantive review by you are not part of the scope of services and are not permitted; every application generated via BewerbungsGenie requires your explicit confirmation before it is sent.

In the event of breaches of these usage obligations, we may block your access.

7. Email and calendar files

BewerbungsGenie can create an email file (.eml) from your documents and a calendar file (.ics) from deadlines. The files are created on your device; we generate the PDF attachments in the same way as the PDF export. BewerbungsGenie does not send emails, does not act as the sender towards employers, does not store access credentials for your mailbox and does not read it.

You review recipient, subject, text and attachments in your email program and send the message yourself. You are responsible for the content, the recipients and the timing of sending. Subject and cover text are templates and do not replace your own review.

We take a suggested recipient address from the job posting; we do not warrant that it is correct or up to date. Statutory warranty rights remain unaffected.

We are not liable for the delivery, display or processing of the files by email or calendar programs or by recipients. Liability for intent, gross negligence and personal injury remains unaffected.

8. Liability and warranty

The statutory warranty rights for digital services under the Austrian Consumer Warranty Act (VGG, Verbrauchergewährleistungsgesetz) apply to BewerbungsGenie. We do not restrict them; the following paragraphs on liability and third parties do not affect them.

During the term of the contract we provide the updates needed to keep BewerbungsGenie in conformity with the contract, including security updates.

If BewerbungsGenie is defective, you can require us to remedy the defect. Under the statutory conditions you can reduce the price or terminate the contract. An informal statement to us, for example by email, is sufficient.

If we need to check whether an error is caused by your device or browser, we ask for reasonable cooperation, for example a screenshot or your browser and version.

Your warranty claims become time-barred three months after the end of the statutory warranty period.

We are liable without limitation for intent and gross negligence and for personal injury. For slight negligence we are only liable for breach of material contractual obligations and limited in amount to the foreseeable, typical damage for this type of contract; mandatory provisions of the Austrian Consumer Protection Act (KSchG) remain unaffected.

We do not warrant that an application created with BewerbungsGenie will lead to an invitation, an interview or a job offer. The success of an application depends on numerous factors outside our control. We are not liable for the factual accuracy of AI-generated suggestions, in particular where notices from the evidence check have not been resolved; the duty to review lies with you. Statutory warranty rights remain unaffected.

We do not warrant the content or availability of third-party job portals and job postings that BewerbungsGenie displays. The statutory warranty applies to the functions of BewerbungsGenie itself, including where we use third-party AI or payment services for them.

9. Data protection

The Privacy Policy applies.

10. Final provisions

Austrian law applies, excluding its conflict-of-law rules and excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of law does not deprive you of the protection afforded by mandatory consumer protection provisions of your country of habitual residence: for consumers in the EU and the EEA this follows from Art. 6(2) of Regulation (EC) No 593/2008 (Rome I); for consumers in third countries it applies accordingly.

For actions against consumers, the court of their place of residence has jurisdiction; for actions by consumers against us, the statutory places of jurisdiction apply (§ 14 KSchG; within the EU, Art. 17 et seq. of Regulation (EU) No 1215/2012, Brussels Ia).

Dispute resolution: the European Commission’s Online Dispute Resolution platform was discontinued on 20 July 2025 (Regulation (EU) 2024/3228); a link to it is therefore omitted. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body within the meaning of the Austrian Alternative Dispute Resolution Act (AStG). For complaints, please contact us directly first.

Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected.
